The Democrats are bound to waste the Kavanough hearings asking him to admit he’s already made up his mind to destroy reproductive choice – something he will fend off with airy nonsense about hypotheticals and open minds. Instead, maybe they could ask hard questions

  • You were a core member of Ken Starr’s team that filed multiple charges against President Clinton for, what in the end, was all about a consensual affair.  Years later you wrote: “Looking back to the late 1990s, for example, the nation certainly would have been better off if President Clinton could have focused on Osama bin Laden without being distracted by the Paula Jones sexual harassment case and its criminal investigation offshoots,.  Is that your current opinion?
  • Did you send President Clinton an apology?  If not, why not?
  • Do you think that you may have contributed to the World Trade Center Bombing by forcing President Clinton to spend time defending himself in court instead of working on his duties to defend the United States? If not, why not? Did you apologize to families of people killed in the terrorist attack on New York?
  • It certainly looks like your opinion changes, depending on whether the Republican Party is in the White House or not. What evidence do you have that you have principles that apply to both parties?
  • If the President of the United States is charged, on probable cause, with working as an agent of a foreign power, do you think it would be a “distraction” for him to have to defend himself in court?
  • If the US Senate leadership and the President are both working for or being blackmailed by a foreign power, what remedy does the Constitution provide? None? Do we have to wait for elections? What happens if Judicial, Executive, and Congressional actions limit voting rights with the effect of protecting these Congressional leaders from the judgment of voters?
  • If there is probable cause to believe a foreign power both compromises the integrity of elections and has some control over Congress and the Executive, and the Court forbids law enforcement from acting, what remedy to citizens have? Are we down to the Second Amendment?
  • Did you know that 4 senior Republican Senators spent the 4th of July in Moscow? Do you think there is a possibility that they are somehow compromised?
  • Do you agree that a Judge who has business or personal interests that involve a party in litigation should recuse himself? If not why not? How can the citizens rely on a judiciary where there is an appearance that judicial decisions are based on favors?
  • If Justice Kennedy was discussing his successor with the White House over the last term, does that make his deciding votes in favor of White House positions problematic? Are such votes a violation of judicial procedure? Do citizens need to respect Supreme Court decisions that are corrupt?
  • Do physicians have the right to provide correct information to their patients or can the Courts and Legislatures tell them what to say? For example, some Catholics and Muslims think birth control is wrong: can Congress or Courts or State Legislatures order physicians to keep birth control methods secret from patients or give them advice that is false?
  • Could a devout Muslim serve well on the Supreme Court? What about a devout Reform Jew? A Quaker?
